The NSW Department of Education and Training NTBE list


Under relevant legislation, the NSW Department of Education and Training maintains a list of persons who are not to be employed in any capacity with the department. The legislation itself provides no details on the reasons that the department may use when placing a person's name on this list.

Brian Carter has supplied a document obtained as part of a Freedom of Information request giving the reasons a person can be placed on the list. These include child protection reasons (with or without proven charges), open allegations, criminal offences, inefficiency, medically unfit (determined by HealthQuest or resigning due to health problems) or being unsuited to teaching.

Any of these reasons can result in staff being placed on the Not To Be Employed (NTBE) list barring them from employment with the department.

You need to post the evidence that carennetruth is Lee Churches and demand that she be placed on this list.

the department would never place a fine teacher like lee on the list, she is true leadership material. she could have gotten the principal's job but didn't even apply for it this time because she would rather work in the classroom

Is her leadership the reason bullying is prevalent at Carenne? It seems like she bullies staff, parents and students.

Is the Director General neglecting his duties? He has been advised of the behaviour of this woman and still nothing has been done.

Section 83 of the Teaching Services Act 1980

A member of the teaching service who:

a) commits any breach of this Act or the Regulations;

b) engages in any misconduct;

c) uses intoxicating beverages or drugs to excess:

d) wilfully disobeys, or wilfully disregards, any lawful order made or given by a person having authority to make or give the order;

e) is negligent, careless, inefficient or incompetent in the discharge of their duties; or

f) engages in any disgraceful or improper conduct;

is guilty of a breach of discipline.

An alleged breach of discipline is dealt with by the Director-General or a prescribed officer.

A prescribed officer is an officer holding or acting in the position of deputy director-general, assistant director-general, general manager, executive director, director or district superintendent who has been appointed by the Director-General to deal with the charge.

What really needs to happen is people other that those identified as pushing the inquiry into Carenne. Need to make formal complaints about the conduct of people like Lee Churches. Certainly many readers of sydney indy and Google cache have access to and evidence of the use by the person or persons who have identified themselves as Lee Churches using email addreses used to bully and mislead readers of indymedia an intertnational net work of public trust journalist.
